Colodny, Fass, Talenfeld, Karlinsky & Abate, P.A. has a comprehensive insurance regulatory practice representing in excess of 100 insurance-related entities, including insurance companies, reinsurers, managing general agencies, agents, reinsurance intermediaries, premium finance companies and other insurance-related entities. The firm’s areas of specialty include life, health, annuities, surety and property and casualty insurance, including automobile, homeowners, commercial, medical malpractice, workers' compensation insurance, reinsurance, among other areas.
Over the years, the firm has established close relationships with numerous senior officials within various state Departments of Insurance, including, but not limited to, Florida, Alabama, Georgia, Louisiana, South Carolina, Texas, Oklahoma, Illinois and Nebraska. The firm has significant regulatory experience involving a wide range of licensing and compliance issues in these states and has been instrumental in assisting clients in establishing beneficial relationships with these state Departments.
The firm represents its clients in connection with a variety of matters, including the formation and financing of insurers, mergers and acquisitions, adding lines of business and expansion into other states, various licensure matters, multiple compliance issues, market conduct examinations, financial issues, statutory accounting procedures, RBC levels, capital infusion issues and financing arrangements, rate, form and rule filings, agent and agency matters and a wide variety of other insurance-related regulatory issues.
In addition, the firm works closely with a variety of state-run joint underwriting associations and guarantee funds and was instrumental in the creation of the Florida and Louisiana residual property markets. The firm previously served as general counsel for the Florida Residential Property and Casualty Joint Underwriting Association and its successor, Citizens Property Insurance Corporation, and continues to represent Citizens in connection with a variety of matters. Furthermore, the firm has represented the Florida Office of Insurance Regulation, Division of Rehabilitation and Liquidation, with regard to the marshalling of assets.
Additionally, the firm has developed close relationships in connection with senior officials of a number of insurance-related associations, including the National Association of Insurance Commissioners, the American Association of Managing General Agents, the Association of Insurance Compliance Professionals of America, the Louisiana Insurance Conference, the Property Casualty Insurers Association of America, the Florida Property and Casualty Association, the Southeastern Regulators Association and the National Conference of Insurance Legislators.
Colodny, Fass, Talenfeld, Karlinsky & Abate is also a member of the Federation of Regulatory Counsel (FORC) and the Society of Financial Examiners and the Louisiana Insurers' Conference.
The Firm also has received the AM Best "Best's Recommended" Insurance Attorneys endorsement.
As a service to its clients and interested colleagues, the firm provides frequent updates and bulletins on various matters of interest in the insurance industry. These updates pertain to issues related to matters of nationwide scope, including, but not limited to, the Terrorism Risk Insurance Act, OFAC compliance, federal legislative initiatives and NAIC developments. The bulletins also pertain to specific issues related to the Florida insurance market, including, directives, orders and memoranda issued by the Florida Office of Insurance Regulation and the Florida Department of Financial Services, Florida rule development and task force updates, task force and committee deliberations, as well as legislative updates.
